For several decades, most discussion on financial fraud has centered on the fraud triangle, which has evolved over time through various extensions and re-interpretations. While this has served the profession well, the articulation of the human side of the act is indirect and diffused. To address this limitation, this research develops a model to explain the role of human desires, intentions, and actions in indulgence of, or resistance to, the act of financial fraud. Evidence from religion, philosophy, sociology, neurology, behavioral (...) economics, and social psychology is integrated to develop and support an alternative fraud model, called the disposition-based fraud model. To articulate the model, its two primary components, disposition and temptation, are further developed and extended. Although the DFM is generally applicable to any act of fraud, this paper focuses on executive fraud. The similarities and differences between the DFM and extant fraud models are discussed. Importantly, in light of the DFM, a re-interpretation of the fraud triangle is made to improve our understanding of the human element in it. Additionally, potential implications of the model for corporate governance are discussed, suggestions for further research are offered, and the DFM’s strengths and limitations are noted. (shrink)

There is currently great anxiety among literary critics and theorists about literary criticism’s loss of identity, both as an identifiable, coherent discipline with a recognizable set of problems and as a body of authoritative and well-founded convictions about literature and its history. Part of the reason for this anxiety is that everything that was until recently considered relatively unproblematical has now been rendered problematical. The hermeneutic of suspicion emerges as an interpretative strategy, pitting itself against the hermeneutic of belief; radical (...) indeterminacy of meanings challenges the certainty of traditional epistemology which authorized the objectivity of meaning, text, and context; and the whole of the Western metaphysical tradition is “inscribed” in any piece of writing which undermines the traditional notions of canon-formation, evaluation, and responsible criticism. Traditional literary theory assumes literary works to be structures of determinate meaning accessible by objective critical procedures. It is this assumption, and along with it a number of critical practices, which are challenged by the contemporary interest in the indeterminacy of meaning. In deconstruction, the thesis of indeterminacy takes its most radical and thoroughgoing form, so that all modernist critical stances from new Criticism to phenomenological, psychoanalytical, structuralist, marxist, and reader-response criticisms are put into question. This renders the scene of contemporary criticism and its theory highly volatile, since every theoretical claim or critical practice has become vulnerable to the deconstructive critique, even if this critique itself requires some form of certainty to question any critical theory or practice. We present a framework for analyzing black hole backreaction from the point of view of quantum open systems using influence functional formalism. We focus on the model of a black hole described by a radially perturbed quasi-static metric and Hawking radiation by a conformally coupled massless quantum scalar field. It is shown that the closed-time-path (CTP) effective action yields a non-local dissipation term as well as a stochastic noise term in the equation of motion, the Einstein–Langevin equation. Once the thermal (...) Green's function in a Schwarzschild background becomes available to the required accuracy, the strategy described here can be applied to obtain concrete results on backreaction. We also present an alternative derivation of the CTP effective action in terms of the Bogolyubov coefficients, thus making a connection with the interpretation of the noise term as measuring the difference in particle production in alternative histories. Si això és així, es pot afirmar que les convergències institucionals en aquest punt es sustenten en una epistemologia interessada. (...) Segon, el pathos de la distància definit per Nietzsche, així com l’assumpció per part de les noves ideologies urbanístiques del primitiu paper de la “casta sacerdotal”, permetrien actualitzar la crítica envers “el civisme”, entès aquest, com l’expressió més recent i efectiva de les cultures de control. I tercer, aquesta epistemologia interessada, permetria reclamar la noció marxiana de lluita de classes per interpretar un crònic i generalitzat menyspreu sobre una part important de la població més irredempta d’un dels barris més convulsos d’Europa. Entre 1919 et 1923, Martin Heidegger (1927-1976) caresse le voeu de faire "exploser l'ensemble du système traditionnel des catégories". C'est avant la parution de son maître ouvrage Etre et Temps (1927), qui consacra la "question de l'être" comme fondamentale, tout en ravalant ses propres essais antérieurs au rang de simple propédeutique. En réalité, ces essais de jeunesse recèlent un projet philosophique original et ambitieux. Le jeune philosophe y soupçonne en effet toute conceptualisation de masquer le mouvement de la vie et (...) d'éteindre l'inquiétude native de la pensée qui y trouve pourtant son ancrage irréductible. Il exige donc que les questions philosophiques fondamentales soient désormais interprétées à partir de la concrétude propre de la vie. C'est ce qu'on a appelé rétrospectivement son "herméneutique de la facticité". La "vie" devient alors le leitmotiv de la pensée du jeune Heidegger, pointant vers une sphère originaire, celle de l'expérience facticielle, d'où le philosopher trouve sa provenance, dont il doit rendre compte et où il revient toujours. Ce livre retrace le développement des thèses du jeune Heidegger et en dégage l'originalité et l'intérêt philosophiques propres plutôt que de les considérer sous l'éclairage rétrospectif d'Etre et Temps. Lors du dégagement du xyste de Delphes, en 1985, a été découvert un en-tête de traité mutilé et en partie ravalé, qui n'a conservé que son titre. Je propose d'y reconnaître la vignette du traité conclu au lendemain de la guerre du Péloponnèse entre Thasos et Néapolis sous la protection de Delphes et Paros, déjà connu par un exemplaire trouvé à Paros (IG XII 5, 109). Les quatre divinités représentées seraient Zeus, Apollon, Parthénos et Héraclès.

Hmarcuse s'est livré, dans Reason and Revolution, à une critique de fond de la philosophic politique d'Auguste Comte, en qui il va jusqu'à voir un precurseur du fascisme. II reproche au positivisme de ravaler la pensée à une pure soumission de l'esprit aux faits extérieurs, ce qui aboutit en politique à une soumission de l'individu au pouvoir et à l'ordre établi: « Le rejet positiviste de la métaphysique s'accompagnait ainsi du rejet de la prévention de l'homme à changer et à (...) réorganiser ses institutions sociales en accord avec sa volonté rationnelle.».
